  • This agreement contains the entire understanding between the Photographer and the Client. It supersedes all prior and simultaneous agreements between the parties. The only way to add or change this agreement is to do so in writing, please put a check mark by each term

  • Session & Payment

  • 1) The session fee covers the payment of the time spent taking photos, as well as the digital images and you have the right to choose whichever package or option you see fit. I reserve the right to lengthen or shorten the session time depending on the client and horse, but not drastically upon the agreed amount of time spent per package. It's the clients responsibility to know exactly what session you are choosing and the price.

  • 2) Travel fees may be included depending on distance, but will be discussed with you prior to booking.

  • 3) Payments must be made through check (payable to Callie Heroux) or cash. Payment is required immediately following the session, and images will not be started, edited, or received until payment is completed.

  • 4) Canvas and print payments are not required the day of shooting. The client will have the ability to see the images and choose after delivery and purchase through my gallery system.

  • Cancellation & Refunds

  • 1) Be upfront and courteous with scheduling, I require at least a two day notice if you are unable to follow through with said date. When a date is agreed upon, both the client and photographer must follow it unless an uncontrollable situation takes place: illness, inclement weather, emergency, etc. I am willing to reschedule if possible, but after a second request or reschedule is not followed through I have the right to refuse scheduling a third spot.

  • 2) Reshoots and refunds are only granted at my discretion. Callie Heroux Photography delivers only quality product, and if I have failed to due to reasons outside my control (i.e. weather situation, horse behavior, etc) I will provide a refund or discount. I understand that horses are animals and have the capability of refusing to participate. Any other excuse will not qualify for a refund.

  • 3) If you are over one hour late to your scheduled time I will consider the session canceled.

  • Digital Images

  • 1) Your images will be sent via email through a private image gallery through my website, where you will be able to download the images high quality directly to your computer. It is your responsibility to download the images upon receiving them. Each email invite with include details on downloading, reminders, and applicable discounts.

  • 2) You will not receive all images taken. I have the right to include more images than stated, but will not produce less images than previously agreed upon by said session package.

  • 3) Digital images will be received at maximum three weeks after payment, but I will give you an estimate after the session that may vary from said date due to the type of session or current circumstances. If for unforeseen reason the images take longer, the client will be notified.

  • 4) If you require expedited editing there are varying expedited fees for images to be delivered sooner than given date. Please inquire for more information.

  • 5) Family and friends may access the gallery and download, there is no limit on downloads, but it isn’t my responsibility to share to all the parties.

  • 6) All extensive retouching and enhancement to the images included in the session fee. If there are extra edits that you require after receiving them, please discuss with me and extra charges may apply per image. Under no circumstances will you receive unedited previews or proofs, Callie Heroux Photography delivers only completed imagery.

  • 7) Modification or alteration of any digital image is unacceptable and by signing this agreement the client is agreeing to preserve the image as it is received. Do not edit, re-alter or change any image in anyway, including cropping or filters, if you decide to share the digital file through social media.

  • 8) Callie Heroux Photography retains copyrights of all images and reserves the right to use the images and/or reproductions to share through my website, social media, marketing, and promotional reaches. The Photographer owns the perpetual, irrevocable, non-exclusive, transferrable copyrights so that they might use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display provided services, in whole or in part, worldwide and/or to incorporate it in other works in any form, media, or technology now known or later developed, all subject to the terms of any applicable license

  • 9) NOTICE OF COPYRIGHT: It is ILLEGAL to copy or reproduce these photographs elsewhere without Studio’s/Photographer’s permission, and violators of this Federal Law will be subject to its civil and criminal penalties. Under no circumstances can a client use images for commercial purposes, profit, or photographic competition

  • Liability

  • 1) Signing this agreement hereby states that you, as the client, acknowledges that horses are dangerous animals and as a photographer I will not be liable for any injury that may occur due to the session. I reserve the right to cancel or stop the session if I feel that you or your horse are in danger, or if I feel that the client is not acting responsibly. Neither Party shall be in breach of its obligation under this Agreement (other than payment obligations) or incur any liability to the other Party for any losses or damages of any nature whatsoever incurred or suffered by that other (otherwise than under any express indemnity in this Agreement) if and to the extent that it is prevented from carrying out those obligations by, or such losses or damages are cause by, a Force Majeure Event except to the extent that the relevant breach of its obligations would have occurred, or the relevant losses or damages would have arisen, even if the Force Majeure Event had not occurred.

  • 2) The Client agrees, to the fullest extent permitted by law, to limit the liability of the Photographer and the Photographer’s associates on the service provided for any and all claims, losses, costs, damages of any nature whatsoever or claims expenses from any cause or causes, including attorney’s fees and costs and expert witness fees and costs, so that the total aggregate liability of the Photographer and all those named in association shall not exceed the Photographer’s total fee for services rendered on this provided service, whichever is greater. It is intended that this limitation apply to any and all liability or cause of action however alleged or arising unless otherwise prohibited by law.

  • 3) I will not shoot mounted photos without a helmet unless the client specifically agrees to it and only if they feel comfortable. You know your horse better than a third party. Do not feel obliged to do anything you are not comfortable with.

  • 4) Sessions must be done on property that the client is given permission to use. It is not the photographer’s responsibility to seek permission or find locations for equestrian safe and available locations. If trailering to another location, I must approve and you must obtain permission from said party.

  • 5) Unacceptable Quality: Where services provided are not of an acceptable technical quality, making it un fit the purpose of its specified use, then no fee or job related costs are due to the Photographer. The Photographer has the right to rectify the defect causing the rejection within a reasonable time, having regard to the urgency of the work. If rectified, the Photographer is entitled to their fee and service related expenses but may not charge the Client an extra fee or cost for rectifying the defect. Further, if the Photographer produces services that are in the same style and structure as the Photographer’s past work, by reference of the Photographer’s portfolio, the Client is deemed to have accepted the Photographer’s artistic interpretation.

  • 6) All claims and disputes arising under or relating to this Agreement are to be settled by binding arbitration in the state of [enter your state] or another location mutually agreeable to the parties. An award of arbitration may be confirmed in a court of competent jurisdiction.
